MYSHUTTLE.AI TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern access to and use of MyShuttle.ai, including its websites, guest shuttle-request pages, shuttle tracking pages, hotel interfaces, dispatch interfaces, driver interfaces, mobile applications, and related services (collectively, the "Service").
MyShuttle.ai is operated by BARK HOSPITALITY, LLC ("MyShuttle," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. PURPOSE OF MYSHUTTLE
MyShuttle is a technology platform designed to help participating hotels and transportation operators coordinate hotel shuttle services. Features may include guest pickup requests, hotel-code-based routing, dispatch coordination, driver pickup information, live vehicle location, ETA and routing information, guest tracking, optional guest GPS-location verification, driver location/status information, and communications among hotels, dispatchers, drivers, and guests.
2. MYSHUTTLE IS A TECHNOLOGY PLATFORM
Unless expressly stated otherwise, MyShuttle provides software and technology used to coordinate transportation. MyShuttle is not, solely by providing the Service, a hotel, common carrier, taxi company, limousine company, transportation network company, airport authority, or the owner or operator of every shuttle displayed through the Service.
The participating hotel or transportation provider remains responsible for actual vehicle operation, drivers, passenger safety, licensing, insurance, permits, and regulatory compliance.
3. HOTEL CODES
MyShuttle uses hotel codes as hotel identifiers to direct a guest to the appropriate participating hotel's shuttle service.
A hotel code is an internationally used designation or identifier associated with a particular hotel. MyShuttle uses it to identify the applicable property and load the correct shuttle-request information and services.
The hotel code is not a password, personal account credential, or guest authentication code.
Guests may receive or obtain the applicable hotel code from the participating hotel or authorized hotel information. Entering a valid hotel code does not itself guarantee transportation.
Users may not intentionally misuse the hotel-code system to submit fraudulent requests, interfere with another hotel's operation, attempt unauthorized access to administrative, dispatch, or driver systems, or use automated methods intended to disrupt or overload the Service.
4. SHUTTLE PICKUP REQUESTS
Submitting a pickup request does not guarantee transportation or a particular pickup time. Requests may be affected by vehicle availability, demand, traffic, weather, road closures, airport conditions, construction, driver availability, mechanical problems, hotel policies, inaccurate pickup information, GPS availability, or circumstances outside reasonable control.
5. ESTIMATED ARRIVAL TIMES
Arrival times, waiting times, travel times, distances, and routes are estimates only and may change. Users should allow additional time for flights, cruises, appointments, connections, or other time-sensitive events. To the extent permitted by law, MyShuttle and participating transportation providers are not responsible solely because an estimate changed or was inaccurate.
6. GUEST INFORMATION
A guest may be asked to provide a name, number of passengers, pickup location, destination, hotel code, and other information reasonably necessary to coordinate transportation. Users agree to provide reasonably accurate information.
7. OPTIONAL GPS LOCATION VERIFICATION
Certain features allow a guest to voluntarily share the device's current GPS location during an active shuttle request. When offered, MyShuttle requests affirmative permission before accessing that location.
The guest's current device location may be temporarily processed to compare the guest's current position with the pickup location entered in the request, help confirm that the guest appears to be at or near the requested pickup point, assist the driver or authorized hotel personnel in locating the guest during an active pickup, and coordinate transportation.
The guest's precise live device GPS location is not stored as part of the completed guest record in the MyShuttle database.
MyShuttle may separately retain GPS coordinates associated with the requested pickup point. Those coordinates identify the transportation pickup location and are not a retained history of the guest's live device location.
When the driver marks the request DONE, the guest's temporary live-location information is no longer available to drivers or front-desk personnel through the normal operational interface. MyShuttle does not use temporary guest device location for advertising, unrelated location profiling, or tracking after completion.
8. LOCATION ACCURACY
GPS and other location technologies may be affected by buildings, airports, parking structures, multiple roadway levels, device settings, satellite visibility, cellular reception, Wi-Fi positioning, browser permissions, hardware limitations, and third-party mapping services. Users should verify pickup details such as terminal, door, island, floor, or pickup area when appropriate.
9. DRIVER AND VEHICLE LOCATION
Displayed shuttle positions may be approximate or delayed due to GPS update intervals, internet connectivity, device power management, application state, cellular conditions, server communication delays, or other technical conditions.
10. NAVIGATION AND ROUTING
Routes and navigation information are informational only. Drivers remain responsible for traffic laws, road signs, safe and lawful routing, actual roadway conditions, and safe vehicle operation.
11. DRIVER SAFETY
Drivers must not interact with MyShuttle in a manner that distracts from safe vehicle operation and should stop or park safely before using controls requiring significant attention.
12. EMERGENCIES
MyShuttle is not an emergency transportation or emergency communications service. In an emergency, contact 911 or the appropriate local emergency service.
13. RESPONSIBLE USE
Users may not submit fraudulent pickup requests, harass users or staff, interfere with shuttle operations, attempt unauthorized access, introduce malware, scrape data without authorization, probe security vulnerabilities without written permission, impersonate another person, manipulate GPS or operational information for fraud, reverse engineer protected portions except where permitted by law, use the Service unlawfully, or intentionally overload or disrupt the Service.
14. HOTEL AND TRANSPORTATION PROVIDER RESPONSIBILITIES
Participating hotels and transportation providers are responsible for driver qualifications and supervision, vehicle licensing and maintenance, commercial and airport permits, insurance, passenger capacity, accessibility, transportation-law compliance, safety procedures, and internal policies.
15. THIRD-PARTY SERVICES
MyShuttle may rely on third-party maps, routing, GPS, navigation, hosting, internet, browsers, operating systems, and communications infrastructure. Those services may be unavailable or inaccurate and may have their own terms and privacy policies.
16. SERVICE AVAILABILITY
Continuous service cannot be guaranteed. MyShuttle may modify, suspend, or discontinue features when reasonably necessary for maintenance, security, legal compliance, or product development.
17. INTELLECTUAL PROPERTY
MyShuttle.ai and its software, interfaces, designs, text, graphics, logos, functionality, and original content are protected by applicable intellectual-property laws. Except as authorized, protected portions may not be copied, distributed, sold, sublicensed, publicly displayed, modified, or used to create derivative works.
18. PRIVACY
Use of MyShuttle is also subject to the MyShuttle.ai Privacy Policy. Where separate consent is legally required for a data practice, acceptance of these Terms does not replace that consent.
19. SECURITY
We use reasonable administrative, technical, and organizational measures intended to protect information handled through the Service. No internet-connected system can be guaranteed completely secure. Suspected unauthorized access or security issues should be reported through the MyShuttle Contact & Privacy Request Form. Select Security Concern when submitting the request.
20. CHILDREN
MyShuttle is not designed as a service directed to children under 13. A minor should not independently provide precise location information when parental or guardian consent is required by applicable law.
21. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, MyShuttle is provided on an "as is" and "as available" basis. We do not warrant uninterrupted service, perfect GPS accuracy, optimal routing, exact ETAs, fulfillment of every pickup request, continuous third-party availability, or error-free operation. Nothing here excludes rights or warranties that cannot legally be excluded.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, MyShuttle and its operators, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the Service, including losses associated with missed flights, cruises, appointments, delays, inaccurate ETAs, GPS inaccuracies, network failures, or third-party mapping/routing errors. Nothing limits liability that cannot legally be limited.
23. CHANGES TO THE SERVICE
MyShuttle may add, remove, improve, or modify features from time to time.
24. CHANGES TO THESE TERMS
We may update these Terms periodically. Material changes will include a revised Last Updated date and any additional notice or consent required by law.
25. GOVERNING LAW
Unless applicable law requires otherwise, these Terms will be governed by and construed in accordance with the laws of the State of Nebraska, without regard to conflict-of-law principles.
Any dispute not otherwise governed by a separate written agreement will be handled in a court of competent jurisdiction as permitted by applicable law. Nothing in this section limits consumer protection, privacy, or other statutory rights that cannot lawfully be waived or restricted.
26. COMPLIANCE WITH APPLICABLE STATE LAW
MyShuttle.ai is operated by BARK HOSPITALITY, LLC from the State of Nebraska and may provide services to participating hotels and users located in other states.
Nothing in these Terms is intended to waive, restrict, or eliminate any consumer protection, privacy, data-security, accessibility, transportation, or other right or obligation that cannot lawfully be waived under applicable federal, state, or local law.
When the Service is provided to participating hotels or users in the State of Washington, applicable mandatory Washington laws remain applicable notwithstanding the Nebraska governing-law provision in these Terms.
If a provision of these Terms conflicts with a mandatory provision of applicable law that cannot legally be varied by agreement, the mandatory law will control to the extent of that conflict.
27. SEVERABILITY
If any provision is invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
28. NO WAIVER
Failure to enforce a provision does not waive the right to enforce it or another provision later.
29. ENTIRE AGREEMENT FOR PUBLIC USERS
These Terms, the Privacy Policy, and any additional feature-specific terms govern public use of MyShuttle. Participating hotels and commercial customers may be subject to separate SaaS, subscription, licensing, or service agreements, which control to the extent of a conflict regarding commercial use.
